At the mention of the word “militia” many people think of secretive, highly-organized gangs with nefarious missions statements.  But what America is coming to realize is that these organizations are actually much better described in a different, more complete way.

The more complete definition of “militia” could be defined as something like this: a group of ordinary citizens who are armed.  These groups can carry out various functions, but one of the most popular roles is to provide law enforcement or defense during times of emergency.  They are not paid and they do not serve a fixed term as described by a contract (the military do both).  In US history, militias have had a significant role, in particular during the Revolutionary War against Britain.  Since America’s early beginnings, bands of armed, organized, laymen have served, and continue to serve chiefly as reserve forces and the country’s first line of defense in the case of a mainland threat or invasion, both domestic and international.

In the United States, there are two categories of militia groups: organized and unorganized.

  • Organized

An example of an organized group are the National Guards.  The National Guard is an organized assembly at the state level.  Each member of this assembly is constantly prepared for the possibility that they may be called into service by their State Governor for a number of domestic threats, such as natural disasters (most often floods and hurricanes).  The compilation of these State forces  across the country  forms the National Guard of the United States which answers to the Federal Government and can be called to action by the President, should the need materialize.

  • Unorganized

Within the unorganized category there are two classes: private and non-private.  In the United States there are many groups of unorganized militia.  Each of the 49 states mainland states have at the very least, one unorganized reserve group (most often private) that are just as prepared as their organized brothers and sisters for emergency action.  Most unorganized militia are private and are fully committed to maintaining and defending US liberties from any and all threat.  One complaint some have against these private, unorganized militia is that the threats these companies react to are thought to sometimes be imaginary or fictional to those from the outside looking in.

Private, unorganized assemblies often take what their National Guard counter-parts do one step further, and begin to resemble social organizations instead of just emergency response teams.  They may also name themselves, such as Maryland’s Citizen Defense League or Montana’s Militia.  Each of these private groupings also have individualized purpose statements, the two most popular points being pro-firearm rights (pro-Second Amendment) and pro-liberty.  They often want to educate their local community about their beliefs and visions of the Country’s future.  Many also have a firm commitment to maintaining the community peace.

Militia groups are as numerous and varied as all the different locations they are in across the continental United States, but their foremost purpose is for Her protection.

Although Chavez goes against everything we hold dear and true in America, and completely contradicts what this country has given her blood, money, and lives for, we acknowledge that he did get something right: how to build and start a militia.

Hugo Chavez, the President of Venezuela, has recently said he that associates of his civilian militia should be given weapon which are to be armed and ready for immediate use, should the need arise. This civilian militia is known as The Bolivarian Militia, structured by the Venezuelan President in the past few years to be an integral part of their nation’s defense. This organization consists of volunteers who reach in age from students to retirees.

Usually, the Bolivarian Militia kept their guns and ammunition under lock and key at military depots, though the volunteers would regularly attend boot camps over the weekends for training purposes. But Chavez knows and has said, like any good organized militia leader, “Who has seen a militia without weapons?”. This change of policy was prompted when Venezuela’s militia leader saw some of his men standing guard only to learn that they had no weapons (guns) on them. Seemed pretty pointless. He told many of his military officers and other high-ranking officials, “militias are the people with weapons”. He went on to describe that their militia should be a stable, enduring, protective entity. As such, a militia and its members “should be armed, equipped, and trained”. He is doing away with the notion that these are un-armed weekend warriors.

Chavez then also said that a country should encourage their people to forma and start a militia.

In the case of the Venezuelan Militia, it is named in honor of Simon Bolivar, a hero and inspiration for Chavez. This militia is formed of a wide variety of ages (as already mentioned), but it also includes a wide array of professions: housewives, engineers, public employees, and everything in between. Their weekend training gatherings are where these members are taught how to fire cannons, mortars, and machine guns. Venezuelan officials say the militia has approximately 120,000 members and are always adding to their numbers.

Chavez personally knows the power and usefulness of an organized militia, as The Bolivarian Militia helped him remain in control during a failed coup in 2002. Beyond asking for the cooperation and protection against domestic threats, he has also called upon his members to defend their country against foreign threats as well, should the need arise (and he says that such a time has come by claiming that America is threatening Venezuela’s oil export).

But here’s the downfall of any militia, and it is especially the true weakness in Chavez’s case: the Venezuelan militia is essentially a personal unit of protection for him (or any other one person who start a militia), not necessarily the country at large. Instead of being a mode of protection for the common good of country, if abused, a militia can easily turn into a violent and powerful device for keeping order (read: “control”, “power”, or “oppression”).

In Utah, the absolutely first thing that you will need to do is to find a group of people who are in love with the United States of America, who are true patriots, who love Utah as much as you, and in the core depths of their heart want to keep, defend, and protect the constitution.  Your potential fellow Utah militia members who want to start a militia in Utah need to be dedicated and 100% available and willing to attend your militia meetings.
2. All of your potential militia members who want to start a militia in Utah need to have an understanding of why you want to start a militia.
What is your militia’s purpose?  What are the core values?  Every Utahan who decides to start a militia in Utah  needs to be aware of, understand, and agree with the goals and purpose that you have set out while starting a militia.
3.  Racism, antisemitism, sexism, and other hate issues should not be the reason that you want tostart a Utah militia. This is un-American and should be treated extremely harshly.
4. Be absolutely sure that you train your militia often and in a coordinated, professional manner.  To start a militia in Utah properly, you need to be sure that you are not just focused on guns and ammunition, but also be focused on physical fitness, tactics, coordination, and other areas that are needed to start and train a militia.
5.  Make sure that you clearly outline every person’s place while starting your new militia.  Be sure to use each new member’s skill sets, training, background, experience, passions, and hobbies to your advantage.  When you start a militia in Utah, you need to remember that each person needs to have a specific duty or job to perform.  Militias do not always hold ranks, but each man is usually free to come and go.  Out of respect, he should be keeping his place in your militia.
6. Make sure that you start your militia in an organized way, and that you keep your members up to date with a website, newsletters, and other media that will help your new militia stay organized.  Distribute videos and other materials to people in your community to help you learn how to start your militia.
7. Keep your militia small – when your militia ends up at around 40 people every meeting, it’s time to split the militia into two groups.  Now, you’ve not only started one militia, but you’re learning how to start other militias in Utah as well!

Legal Issues for Starting a Militia

Legal Issues for New Militias

Nothing in the US Constitution either authorizes or advocates starting a militia.

But that doesn’t mean that it is illegal to start a militia.  If you decide to start a militia, it will be be deemed legal or illegal by your militia’s activities, what laws are in your local or state, and if these laws are constitutional.

When you start a militia, it’s important to remember that your militia will not have any more rights or privileges over and over the rest of the public.  Ciminal law looks carefully at a militia’s activities and it takes very little to find a person guilty when others in your militia are acting illegally.  Even if you weren’t involved, it would be easy to make a case against you.

There is always a threat of a civil lawsuit.  You could be held liable for damages by any member of your militia.  Lawsuits may come not only from civilians, but also other militia members.  It’s a good idea to get your new militia members to sign an “assumption of risk”.  If someone is unsafe, there are lawyers who are out to get you.

  • The most important part to joining a militia – be educated!

The absolutely most important thing for you to do is to start to learn the facts and information surrounding the following subjects:

  1. The history of the United States of America
  2. The history of your individual state
  3. Current events in the United States of America

Florida’s Constitution on Militia

90.29  Paramilitary training; teaching or participation prohibited.

(1)  This act shall be known and may be cited as the “State Antiparamilitary Training Act.”

(2)  As used in this section, the term “civil disorder” means a public disturbance involving acts of violence by an assemblage of three or more persons, which disturbance causes an immediate danger of, or results in, damage or injury to the property or person of any other individual within the United States.

(3)(a)  Whoever teaches or demonstrates to any other person the use, application, or making of any firearm, destructive device, or technique capable of causing injury or death to persons, knowing or having reason to know or intending that the same will be unlawfully employed for use in, or in furtherance of, a civil disorder within the United States, is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(b)  Whoever assembles with one or more persons for the purpose of training with, practicing with, or being instructed in the use of any firearm, destructive device, or technique capable of causing injury or death to persons, intending to unlawfully employ the same for use in, or in furtherance of, a civil disorder within the United States, is guilty of a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

(4)  Nothing contained in this section shall be construed to prohibit any act of a law enforcement officer which is performed in connection with the lawful performance of his or her official duties or to prohibit the training or teaching of the use of weapons to be used for hunting, recreation, competition, self-defense or the protection of one’s person or property, or other lawful use.
